1. Regulatory Compliance Overview

FayeBaby is committed to operating in compliance with applicable laws, regulations, and standards across the jurisdictions we serve. This Compliance page outlines the frameworks, data sourcing practices, and consumer protection measures that govern our platform.

As a product safety and recall monitoring platform serving primarily South African and international users, we adhere to the following regulatory frameworks:

Protection of Personal Information Act, 2013 (POPIA) — South Africa's data protection legislation governing the collection, processing, and storage of personal information.

Consumer Protection Act, 2008 (CPA) — South African legislation protecting consumer rights, including the right to safe products and recall information.

General Data Protection Regulation (GDPR) — European Union regulation on data protection and privacy, applicable where we process data of EU residents.

National Consumer Commission (NCC) Guidelines — South African regulatory standards for unsafe product reporting and recall notifications.

South African Health Products Regulatory Authority (SAHPRA) Standards — Regulatory requirements for health product safety monitoring.

2. Data Sourcing and Accuracy

FayeBaby aggregates product recall and safety data from the following official regulatory sources:

South Africa: National Consumer Commission (NCC), South African Health Products Regulatory Authority (SAHPRA), and Department of Health (DoH).

United States: Food and Drug Administration (FDA), Consumer Product Safety Commission (CPSC), and United States Department of Agriculture (USDA).

European Union: Rapid Alert System for Food and Feed (RASFF) and Safety Gate for non-food consumer products.

United Kingdom: Food Standards Agency (FSA) and Office for Product Safety and Standards (OPSS).

Australia: Australian Competition and Consumer Commission (ACCC) and Food Standards Australia New Zealand (FSANZ).

All recall data is sourced directly from official regulatory publications, press releases, and public databases. We present this data in a user-friendly format but do not alter the substantive content of official recall notices.

Data Accuracy Disclaimer: While we strive to maintain accurate and current recall data, we cannot guarantee that all information is complete, error-free, or up to date at all times. Recall data is subject to change by the issuing regulatory authority. Users should always verify critical safety information by following the official source links provided with each recall entry.

3. Data Processing and POPIA Compliance

In compliance with POPIA, FayeBaby adheres to the following data protection principles:

Lawfulness: We process personal information only on a lawful basis, including consent, contractual necessity, and legitimate interests.

Purpose Limitation: We collect personal information for specific, explicitly defined purposes and do not process it further in incompatible ways.

Data Minimisation: We collect only the personal information necessary for the purposes for which it is processed.

Accuracy: We take reasonable steps to ensure personal information is accurate and kept up to date.

Storage Limitation: We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, subject to legal retention requirements.

Security Safeguards: We implement appropriate technical and organizational measures to protect personal information against loss, damage, unauthorized access, and unlawful processing.

Information Officer: FayeBaby has designated an Information Officer responsible for ensuring compliance with POPIA. Requests regarding personal information access, correction, or deletion should be submitted through our Contact page.

4. Consumer Protection Framework

FayeBaby supports consumer rights under the South African Consumer Protection Act (CPA) and equivalent international consumer protection laws, including:

Right to Safety: Consumers have the right to be informed about products that have been recalled or deemed unsafe by regulatory authorities.

Right to Information: Consumers have the right to access clear, accessible information about product recalls and safety risks.

Right to Redress: Our Certificate of Analysis (COA) request tools enable consumers to seek formal assurances from manufacturers regarding product safety and quality, supporting their right to seek redress under the CPA.

Recall Reporting: Our platform allows users to submit recall reports, which are reviewed by our administrative team before being published or forwarded to the relevant regulatory authority.

We do not act as a regulatory authority ourselves. Our role is to aggregate, organize, and present recall information from official sources, and to provide tools that help consumers exercise their rights.

5. Cross-Border Data Transfers

As our Service serves users across multiple jurisdictions, personal information may be transferred to and processed in countries outside of South Africa, including the United States and European Union.

We ensure that cross-border transfers comply with applicable data protection laws by:

Using service providers that implement adequate data protection measures consistent with POPIA and GDPR requirements.

Implementing standard contractual clauses or other lawful transfer mechanisms where required.

Limiting transfers to what is necessary for the provision of our Service.

Ensuring that recipients of personal information are bound by confidentiality and data protection obligations.

6. Product Safety Standards

FayeBaby focuses on products relevant to infants, toddlers, and young children, including:

Baby nutrition products (formula, baby food, cereals, supplements).

Baby care products (skincare, toiletries, feeding equipment).

Toys and juvenile products (cribs, strollers, car seats, toys).

Food and beverage products that may affect child safety.

Medications and health products for pediatric use.

We monitor recalls issued by regulatory authorities for these product categories and present them with clear hazard descriptions and recommended actions for parents and caregivers.

Our AI-assisted analysis provides plain-language explanations of hazards and recommended safety actions, but this analysis should not replace official guidance from regulatory authorities.

7. Payment Security and PCI Compliance

Subscription payments are processed through Dodo Payments, our third-party payment service provider. We do not collect, store, or process full credit card or banking details on our own servers.

Dodo Payments is responsible for maintaining PCI DSS (Payment Card Industry Data Security Standard) compliance for all payment processing activities.

We receive only transaction confirmation metadata (such as subscription status and billing period) from the payment provider, which we use to manage your subscription.

All payment transactions are encrypted using industry-standard TLS/SSL protocols during transmission.

8. User-Generated Content Moderation

FayeBaby allows users to submit recall reports and contact form messages. We implement the following content moderation practices:

All user-submitted recall reports are held in a "Pending" status and reviewed by our administrative team before being approved for publication.

Submissions may be rejected if they contain false, misleading, or unverified information.

Contact form submissions are protected by an anti-bot captcha challenge to prevent automated spam and abuse.

We reserve the right to remove or edit user-generated content that violates our Terms of Service or is deemed inappropriate or harmful.

Users who submit fraudulent or malicious content may have their accounts suspended or terminated.

9. Compliance Monitoring and Updates

FayeBaby regularly reviews its compliance practices to ensure alignment with evolving regulatory requirements. This includes:

Monitoring changes to POPIA, GDPR, CPA, and other applicable regulations.

Updating our Privacy Policy, Terms of Service, and this Compliance page as needed.

Conducting periodic reviews of our data handling practices and security measures.

Engaging with regulatory authorities and industry bodies to stay informed about best practices in product safety monitoring.

This Compliance page was last updated on 2 July 2026. Material changes will be communicated to users through the Service or by email.
