Terms of Service
Last updated: 2 July 2026
1. Acceptance of Terms
Welcome to FayeBaby. By accessing or using our website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.
These Terms constitute a legally binding agreement between you ("User", "you", or "your") and FayeBaby ("we", "us", "our", or "the Company").
We may revise these Terms at any time by posting an updated version on this page. The "Last updated" date at the top reflects the most recent revision. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
2. Description of Service
FayeBaby is a product safety and recall monitoring platform that provides:
Searchable recall data from South African regulatory authorities (NCC, SAHPRA, DoH) and international authorities (FDA, EU RASFF, CPSC, and others).
AI-assisted product safety analysis and search capabilities, including barcode and text-based search.
Consumer protection tools, including Certificate of Analysis (COA) request generation and tracking.
Personal dashboards for tracking search history, saved products, and recall alerts.
Emergency services information and navigation for medical emergencies.
The Service is provided on an "as is" and "as available" basis. We do not guarantee that recall data is exhaustive, complete, or current at all times.
3. User Responsibilities and Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for the following:
Providing accurate and truthful information when creating an account, submitting recall reports, or using contact forms.
Maintaining the confidentiality of your account credentials and being responsible for all activities under your account.
Not using the Service to submit false, misleading, or fraudulent recall reports.
Not attempting to access, tamper with, or disrupt our systems, databases, or security features.
Not using automated tools (bots, scrapers, crawlers) to extract data from the Service without our express written permission.
Not using the Service to harm, harass, or defraud any person or entity, or to violate any applicable law or regulation.
Respecting intellectual property rights and not reproducing, distributing, or commercially exploiting content from the Service without authorization.
Violation of these acceptable use guidelines may result in immediate suspension or termination of your account, and may expose you to legal liability.
4. Subscriptions and Billing
The Service offers a paid subscription plan ("Pro Plan") priced at R99 per month, billed in South African Rand (ZAR).
Billing Cycle: Subscriptions are billed monthly on a recurring basis. Payment is processed through our third-party payment provider, Dodo Payments. By subscribing, you authorize us to charge the recurring fee to your payment method until you cancel.
Auto-Renewal: Your subscription will automatically renew each billing cycle unless you cancel before the renewal date. You can cancel at any time through your dashboard or by contacting us.
Cancellation: Upon cancellation, your subscription will remain active until the end of the current billing period. No refunds are provided for partial billing periods.
Price Changes: We reserve the right to change subscription fees upon reasonable notice. Any price changes will take effect at the start of your next billing cycle following the notice.
Free Access: Certain features of the Service, including browsing public recall listings and accessing emergency services, remain free of charge.
Failed Payments: If a payment fails, we may suspend your Pro access until payment is successfully processed. We are not responsible for any bank fees or charges resulting from failed payments.
5. No Professional or Medical Advice
The information provided through the Service, including recall data, safety analysis, and AI-generated content, is for general informational purposes only.
The Service does not constitute professional medical, legal, or safety advice. AI-generated responses are produced by automated systems and may contain errors or omissions.
You should not rely solely on the Service for decisions about product safety, health, or medical treatment. Always consult qualified professionals and official regulatory sources for definitive guidance.
In case of a medical emergency, contact your local emergency services immediately. The emergency information provided through our Service is supplementary and should not replace professional emergency response.
6. User Liability and Indemnification
You are solely responsible for your use of the Service and any consequences arising from such use.
You agree to indemnify, defend, and hold harmless FayeBaby, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
Your use or misuse of the Service;
Your violation of these Terms or applicable laws;
Your submission of false, misleading, or infringing content;
Your breach of any rights of any third party, including intellectual property or privacy rights.
FayeBaby reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall FayeBaby, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
Loss of profits, data, use, goodwill, or other intangible losses;
Damages resulting from reliance on recall data, safety analysis, or AI-generated content;
Damages resulting from delays, interruptions, or errors in the Service;
Damages resulting from the actions or inactions of third-party service providers, including payment processors.
The total aggregate liability of FayeBaby for any claims arising from or related to the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or R99, whichever is greater.
This limitation of liability applies regardless of the legal theory of recovery, whether in contract, tort (including negligence), strict liability, or otherwise.
8. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that recall data will be accurate, complete, or current at all times.
We disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Recall data is sourced from third-party regulatory authorities and public databases. We do not independently verify all recall information and are not responsible for errors or omissions in source data.
AI-generated content may contain inaccuracies and should not be treated as definitive or authoritative. Always verify critical safety information with official regulatory sources.
You use the Service at your own risk.
9. Intellectual Property
All content, features, and functionality of the Service, including text, graphics, logos, design elements, software, and recall data compilations, are owned by FayeBaby or its licensors and are protected by South African and international intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of the Service without our prior written consent.
Recall data sourced from regulatory authorities remains the property of the respective authorities. We compile and present this data for informational purposes under fair use and public information principles.
User-submitted content (recall reports, contact messages) remains the property of the user, but you grant FayeBaby a non-exclusive, royalty-free license to use, process, and display such content for the purpose of operating and improving the Service.
10. Account Suspension and Termination
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, if we believe you have violated these Terms or engaged in conduct harmful to the Service, other users, or third parties.
You may terminate your account at any time by contacting us through the Contact page or by ceasing to use the Service.
Upon termination, your right to use the Service ceases immediately. We may retain your data in accordance with our Privacy Policy and applicable legal retention requirements.
Provisions of these Terms that by their nature should survive termination shall remain in effect, including sections on intellectual property, limitation of liability, indemnification, and dispute resolution.
11. Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles.
Any dispute, claim, or controversy arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiations between the parties.
If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to mediation in Johannesburg, South Africa, in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).
If mediation fails, the dispute shall be finally resolved by arbitration under the AFSA rules, with the seat of arbitration in Johannesburg. The language of the arbitration shall be English.
You and FayeBaby agree that the courts of South Africa shall have exclusive jurisdiction over any matters not resolved through arbitration.
12. Changes to Terms
We may modify these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page.
We will notify users of material changes by posting a notice on the Service or sending an email to registered users. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service and terminate your account.
